New Feudalism

by John McClaughry. (5 Environmental Law 675 (1975)). In this 1975 law review article, based upon a conference at Lewis and Clark Law School (Portland, Oregon), John McClaughry describes the substance and politics of the Vermont controversy over adopting a State Land Use Plan under Act 250 of 1970, the state’s land use and development control act. The state land use plan finally failed of enactment in 1976, and the requirement that there be such a plan was quietly repealed in 1984. The article is relevant to a current proposal (H. 424, 2017) to create a commission to draft legislation to expand Act 250 in its 50th year , 2020.
